Effective as of August 10, 2026

These terms and conditions apply exclusively to direct bookings of the “Entre Canal & Criée” apartment made through entrecanaletcriee.fr. Together with the booking summary and the confirmation sent to the guest on a durable medium, they form the seasonal rental agreement.

2. Formation and documents of the agreement

The agreement is formed when the guest has provided the requested information, accepted these terms, and paid the full booking amount. The confirmation specifies, in particular, the identity of the primary guest, the stay dates and duration, the number of occupants, the price breakdown, and the services booked. If there is any discrepancy, these specific booking terms prevail over these general terms and conditions.

The primary guest must be at least 18 years old, have the legal capacity to enter into an agreement, and stay at the accommodation for the entire booked period. The booking may not be transferred or sublet without the host’s prior written consent.

3. Description of the accommodation

The rental grants exclusive use of an approximately 74 sq. m furnished apartment located at 87 Grand Rue Mario Roustan, 34200 Sète. It includes a living area with a fully equipped kitchen, two bedrooms, one bathroom, and the amenities shown on the property page. It accommodates a maximum of six guests, including children and infants.

The accommodation includes air conditioning, Wi-Fi, a smart TV, a washing machine, and the amenities required for a short stay. Bed linen, towels, water, electricity, air conditioning, Wi-Fi, and the welcome supplies provided are included in the price.

4. Purpose and duration of the rental

The accommodation is rented as temporary tourist lodging for the dates stated in the confirmation. The guest may not use it as a primary residence, register it as a legal address, conduct a business activity open to the public, or extend the stay without the host’s written consent.

Check-in is available from 3:00 p.m., and the accommodation must be vacated no later than 11:00 a.m. on the departure date unless otherwise agreed in writing.

5. Price, fees, and tourist tax

The applicable total price is the amount displayed and accepted before the booking is confirmed. It includes the rent, the included services listed above, and an €80 cleaning fee shown separately in the booking summary.

Tourist tax is calculated separately in accordance with the regulations in force on the stay dates and the number of liable guests. It is collected with the booking and then remitted to the relevant local authority.

No security deposit is required as of the effective date of these terms. This does not limit the guest’s liability for any damage, loss, or costs caused during the stay.

6. Payment

The full price is payable at the time of booking by bank card or bank transfer. Subject to successful receipt of the funds, full payment definitively confirms the booking. It does not constitute a deposit (“arrhes”) under French law.

For payment by bank transfer, the booking is confirmed only after the full amount has been received within the timeframe communicated to the guest. Otherwise, the dates may be made available again.

7. No right of withdrawal

In accordance with Article L. 221-28, 12° of the French Consumer Code, accommodation services provided on a specific date or during a specific period are not subject to the 14-day right of withdrawal. Cancellation is governed exclusively by the provisions below.

8. Cancellation by the guest

All cancellations must be submitted in writing to reservation@entrecanaletcriee.fr or through the contact form, quoting the booking reference. The date on which the written request is received determines the applicable cancellation terms:

  • At least 30 calendar days before the check-in date: a full refund of all amounts paid.
  • Fewer than 30 calendar days before the check-in date: no refund of the rent.

If the stay has not begun, the cleaning fee and tourist tax will be refunded even when the rent is nonrefundable. No rent refund is due for a no-show, delayed arrival, or early departure initiated by the guest.

9. Cancellation by the host and force majeure

If the host must cancel the booking for a reason attributable to the host, all amounts collected will be refunded without undue delay, without prejudice to any other rights available to the guest under applicable law.

If a force majeure event meeting the requirements of Article 1218 of the French Civil Code prevents the stay from being provided, the affected party must inform the other party without delay and provide relevant supporting documents. The parties will first seek to reschedule the stay. If no agreement is reached or performance is permanently impossible, the financial consequences will be determined in accordance with applicable law and the services actually provided.

10. Self check-in and condition of the accommodation

Check-in is completed independently using a key lockbox or equivalent device. The instructions and codes provided are personal and confidential and must not be shared with a third party.

The guest must inspect the accommodation on arrival and report any issue within 24 hours, with photographs where helpful. This timeframe does not affect the guest’s rights regarding a defect that could not reasonably have been identified on arrival.

11. Insurance

Throughout the stay, the guest must be covered by personal liability insurance that includes vacation rental coverage. A valid insurance certificate must be provided to the host upon request and no later than before check-in.

12. Occupancy and house rules

  • Maximum occupancy is six people, including children and infants.
  • Only guests declared in the booking may enter the accommodation; outside visitors are not permitted.
  • The accommodation is strictly nonsmoking, including electronic cigarettes.
  • Pets are not permitted.
  • Parties, receptions, and events are prohibited.
  • Quiet hours must be observed from 10:00 p.m. to 8:00 a.m., and consideration must be shown at all times in common areas.
  • The condominium rules, neighbors, common areas, furniture, and amenities must be respected.

The primary guest is responsible for the conduct of every occupant. Exceeding the maximum occupancy, allowing an unauthorized visitor, or causing a serious disturbance may result in the early termination of the stay to the extent permitted by law, without prejudice to compensation for any documented damage.

13. Use of amenities and internet access

The guest must use all amenities for their intended purpose and follow the instructions provided. Internet access may not be used to download, access, or distribute unlawful content or infringe third-party rights. Any malfunction or damage must be reported promptly so that appropriate action can be taken.

14. Departure, cleanliness, and return of keys

Before departure, the guest must:

  • wash and put away all used dishes;
  • dispose of trash according to the instructions provided;
  • turn off the air conditioning;
  • close all windows and shutters; and
  • return or replace the keys as instructed.

The cleaning fee covers standard cleaning between stays. Additional cleaning required because the accommodation has been left abnormally dirty may be charged upon presentation of supporting documentation.

Lost or unreturned keys will incur a flat €100 charge. A departure after 11:00 a.m. without prior authorization may also incur a €100 charge if it disrupts cleaning or the next guest’s arrival.

15. Damage and liability

The guest is responsible for any damage or loss caused by the guest or any occupant during the stay and must inform the host immediately of any incident. Necessary repairs or replacements will be charged based on supporting documents and with allowance for normal wear and tear.

The host is not responsible for the loss, theft, or damage of personal belongings unless caused by the host’s fault. No video surveillance device, video doorbell, or connected noise monitor is installed in or around the accommodation.

16. Complaints and dispute resolution

Any complaint must first be submitted in writing to Emeric LESAGE, 87 Grand Rue Mario Roustan, 34200 Sète, or to reservation@entrecanaletcriee.fr, together with any relevant supporting documents.

The host operates under the French tax status of a non-professional furnished rental provider. If an amicable resolution cannot be reached, the parties may use the services of a French court conciliator free of charge. If the activity were to be classified as professional within the meaning of the French Consumer Code, the guest would be provided, in accordance with applicable regulations, with the contact details of the consumer mediator previously appointed by the host.

The agreement is governed by French law. If no amicable agreement is reached, the dispute will be submitted to the competent courts as determined by applicable rules of procedure.

17. Personal data

The data provided during booking is used to enter into and perform the agreement, collect payment, meet legal obligations, and communicate with the guest. It is shared only with service providers required for these purposes and with legally authorized public authorities. Requests relating to personal data may be sent to reservation@entrecanaletcriee.fr.

18. Acceptance and retention

Confirming the booking constitutes unconditional acceptance of these terms. Guests are encouraged to download or retain them with their confirmation. The applicable version is the version accepted on the booking date; subsequent amendments apply only to new bookings.
